The Hearing Examiner appointed by the Maryland Public Service Commission (PSC) has established a deadline of 9/27/10 for people to petition to become interveners in the case before the PSC. Petitions to intervene should be filed with the Commission’s Executive Secretary, Terry J. Romine, at 6 St. Paul Street, 16th Floor, Baltimore, Maryland 21202-6806. URGENT: Must-Attend Hearings

PATH/Allegheny has filed for a Special Exception with the Frederick County Planning Commission and the Frederick County Board of Zoning Appeals. The Planning Commission will hold a hearing on Wednesday, September 15th on the consistency of the ‘Kemptown Substation’ with the Frederick Comprehensive Plan. The Board of Zoning Appeals will hold hearings on Wednesday, September 29th. Allegheny will present its case, then “parties recognized by the board” can cross-examine and give testimony. Individuals will have four minutes to speak as well.

In a nutshell, the proposed location of the substation is zoned to be agriculture and the size, etc., of the substation is such that, if they want Frederick County’s approval to build it, they’re going to need to get an exception. We’ll provide more details as they become available and will also provide you with information on things you can do to help prevent this. One thing is for certain. We need as much community involvement as possible at these hearings. Tell your neighbors, your friends, your family, your coworkers, and anyone else you can think of. Plan to take the days off if at all possible. The hearings will be in Frederick. Please mark these dates on your schedules.

TIME TO STAND UP AND FIGHT!

On July 26th, 2010, the Maryland Public Service Commission posted an order that rules that the PATH application is complete, that discovery commences with the issuance of this order, and that the matter is delegated to the hearing examiner’s division to set a schedule, set a date for intervention for persons who are not already parties, and hear the merits of the case. What this means:
The process of determining whether or not the 765 thousand volt substation and the associated transmission lines get built in Maryland (in our neighborhoods) has truly begun. Much more info to follow. In short, the really hard battle begins now. Let your voice be heard! Environmental Impact Statement for PATH

Here’s your opportunity to comment on the environmental impact of PATH! The National Park Service and US Forest Service will hold public meetings to provide the public an opportunity to review and comment on the PATH project. This scoping phase will determine what gets studied and how it gets studied, so come out to learn and be heard!

PATH has requested permits for a new 765kV line to cross federal lands in MD, VA, and WV: from Four national park units in the vicinity of Harpers Ferry, West Virginia (WV)
– Harpers Ferry National Historical Park (NHP)
– Appalachian National Scenic Trail (NST)
– Chesapeake and Ohio Canal National Historical Park (NHP)
– Potomac Heritage National Scenic Trail (NST)
• The northern portion of Monongahela National Forest in TuckerCounty, WV
The Environmental Impact Statements needs to study the entire PATH Project not just where it crosses federal land.

Important Meetings in Early March

The Maryland Public Service Commission (PSC) will be conducting a hearing on Tuesday, March 2^{nd at 10am} at the William Donald Shaefer Tower, 6 Saint Paul St. in Baltimore, MD. In short, the purpose of the hearing is to have PJM (the regional entity whose members provide electricity in the mid-Atlantic area and beyond) to update the commission on potential gaps in capacity/reliability that might exist in Maryland between now and 2016.

Why this matters to us:

If PJM is not able to show credible evidence/analysis that there will be gaps in reliability in Maryland between now and 2016, then it is possible (maybe likely) that the PSC will not accept the application that Potomac Edison (i.e. PATH), submitted in December 2009. It’s possible the PSC would direct PATH to submit another application only when they can show sufficient need.If you aren’t able to make the trip to Baltimore on March 2^nd, don’t forget that we are having a community meeting on March 4^th at the Providence United Methodist Church on Kemptown Road at 7:00PM. We’ll share what happened at the hearing there.

AlleghenyEnergy has recently been buying even more land near our homes in Frederick County. Several parcels of land along Weller Road and a property at the corner of Weller Road and Lynn Burke Road were acquired by Allegheny to construct NEW transmissions lines that will lead to the proposed substation site. PATH has not been approved in WV, VA, or MD. Volunteers at Citizens Against Kemptown Electric Substation are working to defend our community.
